1. Acceptance of Terms
By accessing or using the Kinetix platform ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the Service. Your continued use of the Service following the posting of changes constitutes acceptance of those changes.
2. Account Registration
You must be at least 16 years of age to create an account and use the Service. By registering, you represent that you meet this age requirement. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep your account information up to date.
3. User Roles and Responsibilities
The Service supports multiple user roles, each with specific responsibilities:
- Gym Owners are responsible for managing their organization, gym details, and member access. Owners may invite and remove members and assign trainers to students.
- Trainers are responsible for creating training programs and meal plans for their assigned students. Trainers must provide programs that are safe and appropriate for their students' fitness levels.
- Athletes (Students) are responsible for accurately logging their workouts and food intake. Athletes should consult with healthcare professionals before starting any new exercise or nutrition program.
4. Subscription and Payments
Certain features of the Service require a paid subscription. Payments are processed securely through Stripe. Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Refunds are handled in accordance with applicable consumer protection laws. All prices are displayed inclusive of applicable taxes unless otherwise stated.
5. Acceptable Use Policy
You agree not to: (a) use the Service for any unlawful purpose; (b) upload or transmit viruses, malware, or other harmful code; (c) attempt to gain unauthorized access to other accounts or systems; (d) interfere with or disrupt the Service or its infrastructure; (e) use the Service to harass, abuse, or harm others; (f) scrape, copy, or redistribute content from the Service without authorization; (g) impersonate another person or entity.
6. Intellectual Property
The Service, including its design, features, content, and underlying technology, is owned by Kinetix and protected by intellectual property laws. You retain ownership of any content you create or upload to the Service (such as training programs and meal plans). By uploading content, you grant Kinetix a limited license to store, display, and process that content solely for the purpose of providing the Service.
7. Data and Privacy
Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you consent to the data practices described in the Privacy Policy.
8. Disclaimers
The Service is a fitness management tool and does not provide medical advice. Training programs and meal plans created through the Service are not substitutes for professional medical advice, diagnosis, or treatment. You use the Service and follow any exercise or nutrition programs at your own risk. Always consult with qualified healthcare professionals before beginning any new exercise or nutrition program, especially if you have pre-existing health conditions.
9. Termination and Account Deletion
You may delete your account at any time through your account settings. Upon account deletion, your personal data will be retained for 30 days to allow for account recovery, after which it will be permanently deleted. Kinetix reserves the right to suspend or terminate accounts that violate these Terms, with notice where reasonably possible.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Kinetix shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, resulting from your use of or inability to use the Service. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of Portugal and applicable European Union regulations. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Portugal, without prejudice to any mandatory consumer protection rules of your country of residence.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
